新型财产制度视域下的环境财产权立法和实践

Environmental Property Rights Legislation and Practice from the Perspective of the New Property System

未来民法典中财产应划分为有形财产和无形财产两大类,将有形物置于有形财产下,无形财产与有形财产保持平行地位。通过建立新型财产制度,增强交易自由度,为多样和复杂的无形财产预留充分制度空间。在新型财产制度视域下,对无形财产之环境财产权进行立法研究,检视现行环境法、合同法、财产法律等需完善之处,并给出改进的方向和措施。

Property in the future civil code should be divided into two categories： tangible property and intangible property, the physical objects should be included in the tangible property, and intangible property as well as tangible property remains in a parallel position. Institutional space should be fully reserved for diverse and complex system of intangible property by establishing a new type of property system and enhancing the trade freedom. From the perspective of the new property system, this article carries out a research on intangible environmental property rights legislation, and examines the flaws of current environmental law, contract law and property law and then puts forward the direction and measures for their perfection.
