建设工程合同解除索赔案例分析

Case analysis on contract dissolution claim in construction projects

法律法规不健全、索赔专业人才缺乏、发包方缺乏索赔经验是造成发包方在合同解除索赔中处于劣势的主要原因.结合案例工程,对当前承发包双方存在的工程索赔经验及理论不对称等问题进行了分析,阐述了发包方在项目管理中的不足及工程索赔面临的问题,以具体案例提出在发包方违约导致工程停工、合同解除等条件下适用的索赔处理方法、技巧和应重点搜集的资料等索赔建议.

Imperfect laws and regulations, lack of claim professionals and lack of claim experi- ences are main reasons of employers being in the bad situation in contract dissolution claim. Ac- cording to the asymmetry in claim experiences and theories of contractors and contractors and employers, combing the case project, this paper analyzes the disadvantages of employers in pro- ject management and problems in project claim, and expounds suggestions of proposing applica rive claim processing methods, skills and data that should be collected preferentially in condition of construction halt and contract dissolution caused by employers.
