基于解释结构模型的部队官兵涉法维权问题研究

On issues of legal rights for soldiers based on interpretive structural model

新形势下《关于进一步加强军人军属法律援助工作的意见》和《关于进一步发挥职能作用维护国防利益和军人军属合法权益的意见》的出台,对军人军属权益保障提出了新的目标要求。在十八届四中全会精神指引下,从依法治军、从严治军的目标出发,结合上述纲要性文件的具体规划,在问卷调查和实地采访的基础上,对部队官兵涉法维权问题进行了思考与分析,并通过解释结构模型来梳理影响该问题的诸多因素之间的关系,构建起关于该问题的解决路径,为进一步解决部队官兵涉法维权问题提出了建议。

The issuing of the documents ＂On Further Strengthening Legal Aids for Military Depen- dents＂ and ＂Opinions on Playing the Functional Role to Maintain the Interests of National Defense and Safeguard the Legal Rights of Military Dependents＂ has made demands on protecting the military de- pendents rights under the new situation. In the spirit of the Fourth Plenary Session of the Eighteenth National Congress of Central Committee of the CPC, from the point of view of law-based army and strict disciplines of the army, and combined with the specific requirement of the documents, reflec- tions and analysis on issues of the law of rights have been made based on the questionnaires and inter- views of the troops. Various factors influencing the problem are analyzed through interpretation. A solution to the problem is proposed to protect the legal rights of army officers and soldiers.
