公安侦查体制改革的理论与实践

A Tentative Study on Theory and Practice of Public Security Investigation System Reform

当前,刑事犯罪总量居高不下,侦查工作日益繁重,在警力编制已无可能大幅度增加的情况下,探索侦查体制改革,实现警力"无增长改善",促进公安队伍全面、协调、可持续发展迫在眉睫。全国许多地方都已进行了侦查体制改革的尝试,有的地方整合了侦查机构,有的地方调整了侦查模式,都取得了一定成效。但改革过程中也遇到了管理体制不统一、机构设置不规范、配套措施跟不上等问题。对此,应参考和借鉴域外好的做法,结合我国实际,建立"大侦查"格局的侦查体制,并从健全完善公安机关组织法律法规、明确事权划分、建立专门的刑事警察管理制度等方面进行改革,以达到合理配置警力资源、提高侦查效能的目的。

Currently,Criminal crimes are still on the increase,posing great challenges to criminal investigation work.It is urgent that public security organs should reform investigation system to realize the improvement of police force and promote the comprehensive,balanced and sustainable development of police force under the situation of zero growth of authorized personnel.Public security organs in different places have conducted tentative reforms about criminal system reform.Investigation institutions have been integrated in some places and investigation models have been adjusted in other places.However,in the process of reform,there are many problems such as disunity of administration mechanism,nonstandard institution setting,mismatching supporting measures,etc.Therefore,combining our own conditions,we shall establish investigation mechanism of ＂big investigation ＂ by referring to foreign experience,and improve laws and regulation concerning public security organs,make clear dividing of powers and authority and establish management system for specialized criminal investigation police for the purpose of allocating police resources in a reasonable way and improving investigation efficiency.
