论《立法法》中法律保留原则之识别标准

On Criterion of Identification of Legal Reservation Principle in Legislative Law

法律保留原则作为立法法中一项重要的原则,存在着人大立法和行政立法权限混乱、下位法违背上位法以及行政解释和司法解释扩权等问题,成为制约法律保留原则实施的瓶颈之一。对此,可以在借鉴美国和德国宪法理论的基础上,结合我国立法的实际,提出"一体两翼式"的识别标准,从而更好地促进立法法的完善、满足法制统一的需要。

Legal reservation principle is an important principle of the legislative law, there exists people ＇s congress legislative and administrative legislation chaos, lower level law against host law and administra-tive interpretation and judicial interpretation expansion problems, which has become one of the bottlenecks to restrict legal reservation principle. Therefore, we can imitate constitutional theory from the United States and Germany, on the basis of legislation in our China＇s reality, put forward the identification criterion of ＂one body two wings＂, to better promote the perfection of the legislative law, and to meet the needs of the unifica-tion of legal system.
