The Anti-trust Restriction for Patent Pool and System Construction

专利联盟作为新型专利许可方式,逐渐成为新世纪各国知识产权战略的重要部分。但是专利联盟不能被神圣化,它具有技术垄断的性质,应当受到反垄断法的合理规制。运用对价平衡理论分析专利联盟的双重效应,能够揭示其固有的技术垄断性和潜在的经济垄断性,构建较为系统的专利联盟普遍审查制度、分级管理制度和救济制度,从反垄断法的视角对专利联盟的合理法律规制提出建议。

Patent pool has been an increasingly important element of the intellectual property’s competition in 21st century as a new patent permission. But this mechanism is not perfect, the paper believes that the monopoly of patent pool should be regulated by Anti-trust Law. The paper tries to use the theory of consideration and balance to analyze the foundation of patent pool, and in-dicate the technological monopoly and the potential anticompetitive monopoly. Further, the paper tries to structure mechanisms of the general inspection and the rating supervision for patent pool, and give corresponding constructive suggestions.
