摘要
劳务派遣是市场主体自发选择的结果。随着市场经济的发展及用工制度的不断革新,劳务派遣作为一种用工形式和就业方式在我国逐渐兴起,且得到快速发展。最新《劳动合同法修正案》、《劳务派遣行政许可实施办法》及《劳务派遣暂行规定》实施以来,为实现在2016年3月1日将劳务派遣用工比例降至规定的10%以内,劳务派遣用工单位积极寻求应对策略。本文通过探究新法颁布后劳务派遣制度在实际执行层面遭遇的突出问题,并探求规范我国劳务派遣制度的可行性对策,以促进我国劳务派遣制度的健康发展。
Labor dispatch is the natural choice of market. With the development of market economy and innovation of recruitment system, labor dispatch, as a way of recruitment and employment, springs up gradually and develops quickly. With the enforcement of the latest Labor Contract Law Amendment, Measures for the Implementation of Administrative Licensing of Labor Dispatch, Temporary Provisions on Labor Dispatch, employing units of labor dispatch actively seek countermeasures in order to reduce the ratio of labor dispatch recruitment to 10% as provided on Mar. 1st, 2016. Through probing into the difficulties when practically implementing labor dispatch system after the recent laws enacted, this paper aims to explore feasible countermeasures to regulate labor dispatch in our nation, which promotes the healthy development of labor dispatch.
