网络版权纠纷中“服务器标准”的适用与完善探讨

随着网络技术的发展,网络版权纠纷日益增多,而司法实践中认定信息网络传播行为时适用的标准不一,导致网络版权保护困难重重。我国立法上对"信息网络传播权"的界定有一定局限性,不能充分规范新技术条件下出现的各种"信息网络传播行为"。信息网络传播行为应当包括作品提供行为和网络服务提供行为,它们是"一机两翼",缺一不可的关系。在认定"信息网络传播行为"时应当灵活适用"服务器标准",以利益平衡原则为指导,并受到合理使用原则、法定许可原则、技术中立原则等的限制。"用户感知标准"、"法律标准"在一定情况下可以弥补"服务器标准"适用的不足。

With the development of network technology, intemet copyright disputes are increasing, but different standards are applied when identify the information network communication behavior in judicial practice, which results in network copyright protection difficulties. Our legislation on the definition of ＂Information Network Transmission Right＂ has some limitations, therefore it can＇t fully regulate a variety of ＂information network communication behaviors＂ appearing under the new technical conditions. Information network dissemination actions should include work provide conducts and the behavior of the network service provider, which are indispensableas ＂a machine wings＂. ＂Server Standard＂should be applied flexibly in the recognition of ＂informationnetwork dissemination behavior＂, and it should be guided by the interests balance principles, while be restricted by the fair use principles of statutory licensing principles and the principles of technological neutrality. Under certain circumstances, ＂User perception standards＂ and ＂legal standards＂ can be applied in order to make up for the deficiencies in the application of ＂Server standard＂.
