摘要
法国是世界上第一个确立追续权的国家,追续权制度自1920年诞生以来,经历了两次重大的变革,其历史嬗变的过程具有典型性。两次变革的结果使得法国追续权制度更加具体化、规范化,更具可操作性。2012年4月至今,我国《著作权法(修改草案)》三稿均涉及到追续权制度的引入,引发了热烈的讨论。就法国追续权制度展开研究对我国追续权制度的构建有着十分重要的借鉴意义。
France is the first country in the world to establish the right of pursuit, French right of pursuit system has experienced two tremendous renovations, the process of its historical evolution is typical. The two renovations made French right of pursuit system more specific, standardized, and more maneuverable. Since April 2012, the draft amendment of the Copy Right Law introduced the right of pursuit, aroused heated discussion. Studying French right of pursuit system has a guidance and reference significance on the construction of this system in China.
