论执行力对诉的利益的阻却——以公证债权文书为中心的分析

Impediment of Executive Force on Litigation Interest——Analysis on Notarial Obligatory Right Document

即使执行名义本身不具备既判力或调解确定效,可以直接诉诸强制执行的债权人因丧失另行取得执行名义的必要性,其所提起的给付之诉通常缺乏诉的利益。债权人在公证债权文书丧失执行力之前不具备提起诉讼的必要性,但债务人在执行力解除之前仍存在着提起诉讼的利益。公证债权文书确定不能进入或者已经退出强制执行程序的,债权人具备针对公证债权提起给付之诉的利益,但不得再围绕着公证债权文书的执行力提起确认之诉。拒不出具执行证书的公证机关应当出具《不予出具执行证书的决定》,否则,债权人可以向司法行政机关申诉或者在申请法院调取证据的基础上,针对执行债权提起给付之诉,但不能请求法院判决责令公证机构出具执行证书。

Even if the basis of enforcement itself does not have adjudged force or determination effectiveness of mediation, some creditors who can directly appeal for compulsory enforcement have no need to obtain nominal enforcement otherwise, and then the action for performance they have initiated is usually lack of litigation interest. Creditors do not necessarily initiate lawsuit before the loss of executive force of notarial obligatory right document. However, prior to the rescission of execution proceedings, there are still benefits for debtors. If notarial obligatory right documents have been determined not to enter or exit enforcement proceed- ings, creditors will have the notarial obligatory right initiating action of performance, but there should be no further declaratory claims involving the execution of notarial obligatory right documents. When the notary organization refuses to issue execution cer- tificate,it should issue the decision of refusing to issue execution certificate, or else, creditors may appeal to a judicial or admin- istrative authority, or they may file a litigation for performance on the basis of court investigation instead of asking court to order the notary organization issuing a execution certificate.
