道德填补法律漏洞的理论探析

法律漏洞的存在是法律自身特征的必然结果。由于我国历史悠久,道德底蕴深厚,再加上道德与法律的密切关系,因此以道德来填补法律漏洞可以取得较好的社会效果。但同时也要注意,在引入道德前要对个案进行道德强度分析和利益权衡,以确定其具有以道德填补漏洞的前提条件。在条件具备的情况下,通过以归纳类似案件的形式选择符合立法意图兼顾地方道德习俗的道德规范,来对法律漏洞进行填补。当然还应当警惕约束法官的自由裁量权,只有在法律规则穷尽的情况下才可以结合主流道德观念进行漏洞的填补。

Loopholes in the law is the inevitable result of the legal characteristics. China has a long history and profound moral, coupled with the close relationship between morality and law, so that filling the legal loophole with moral can get good social effect. But we should also note it is necessary before we lead the moral in law that analyzing the strength of the ethical moral in the case and balancing the interests to determine if it has a precondition to plug the loopholes with moral. When conditions is meeting,we select ethic which accord with legislative intent and take moral practice into account to fill the loopholes by concluding the same cases. Finally it is necessary to impose restrictions on the judges＇ right of discretion. Only in the case which legal rules is exhausted can fill the loopholes combined with the mainstream moral.
