论我国企业职工休假权及法律保护

摘要 休假权是劳动者的重要权利,休假权的现实特征和时代功能对劳动者权益保护的意义十分重大。但是在现实生活中,大量的企业存在着侵害职工休假权的情况。许多用人单位制定了加班的奖励方法,例如给予加班费等;超时、超负荷的工作也成为评选先进的必备要素。这些做法实际上都是对劳动者休息休假权的一种变相侵害。所以重视研究休假权理论,完善休假权的立法保护和侵权救济,让劳动者重视且切实享受到此权利,呼吁用人单位重视建立和谐的劳动关系,充分实现职工休假权,并让休假权这一法律意识深入人心、落到实处,是十分具有现实意义的。 The right to leave is important for labors.The practical significance and the function of the right to leave are beneficial for the protection of labors' rights.However,in the real life,a large number of enterprises violate the right to leave.Many enterprises formulate incentive system for working overtime by providing over- time pay.The overtime and overloading work even has been the essential element of the selection of the ad- vanced worker.Actually, these are in disguised form of violating the right to have holidays and leaves.Therefore, it is essential and significant to take studying the theory of the right to leave seriously,improve the legislation protection and torts and remedies of the right to leave,make labors pay more attention to the right to leave and put it into practice,and appeal enterprises to establish harmonious labor relations.We'd better make everyone have the sense of law and imnlement the right to leave in our daily life.
