摘要
关于工作场所雇员电子通信隐私保护问题,各国的相关立法和法院的判决不尽相同。美国或加拿大更倾向于保护雇主的网络监控利益,而欧盟和法国则更倾向于保护雇员工作场所电子通信的隐私利益。关于我国的立法机构和法院对于上述争议的抉择,建议采取利益平衡的策略,在确保雇员工作场所电子通信隐私利益的同时,也要兼顾雇主的网络监控的利益。
There are differences in the world in the relevant legislation and the court's decision about the protection of the privacy of electronic communications in the workplace. The United States and Canada are more inclined to protect the interests of the employer's network monitoring,while the EU and France are more inclined to protect the electronic communications privacy of the employee's. We suggest that our country's legislative body and the court should take the balance of interests to protect the interests of electronic communications in the workplace,but also take into account the interests of the employer's network monitoring.
