Putting Power into an Institutional Cage According to the Constitution

我国宪法实施的难点在于触动"固有的利益格局"。确定宪法和法律的至上地位是正义实现的关键,保证宪法和法律的实施才能实现正义,"固有的利益格局"是实现正义的最大阻力。制度问题必须通过制度改革才能解决,实现正义始于对公权力掌控者的管控。实现正义必须充分保障公民的言论自由,提高公众的"能见度",防止公权力破坏群众安全感。

The difficulty of constitutional implementation in China is to upset the vested interests structure. Assuring the supreme position of the constitution and ensuring the implementation of constitution and law is the key to realize justice. However,vested interests structure becomes the biggest obstacle. The institutional problems must be solved through the institutional reform,and the realization of justice begins with the control on the controllers of public power. To realize the justice,we must guarantee the freedom of speech for citizens,improve citizens＇ right to learn the truth and prevent the power from damaging the community＇s sense of safety.
