当前,中国医患纠纷呈增长趋势,由此引发的医疗诉讼也日益增多。其中,以侵入性手术为主要手段来治疗疾病的外科是法律风险高发之地。在此背景下,医务人员应当识别外科中常见的法律风险,包括术前、术中、术后法律风险,了解外科医疗行为中应当履行的各项法律义务,合法合规地提供医疗服务;医疗机构则应当完善内部法律风险管理体制,大胆引入"第三方"参与的监督、见证机制;国家则应当加快创新医疗法律制度的步伐,寻求法律纠纷解决机制的多元化,以防范各类法律风险。

Recently,medical litigations resulting from patient-doctor disputes have been increasing annually.Surgery,which treated diseases by means of surgical repair and resection,is a field of high incidence of legal risk.In this background,medical staff should identify and be on guard common legal risk in clinical surgery,including risk before surgery,risk during surgery and risk after surgery.Also,they should know their legal obligations and serves patients legally.The hospital should improve the ability of controlling legal risk and introduce the oversight mechanisms from third party.And the state should accelerate the pace of innovation in medical legal system to regulate various legal disputes.
