The Localization Path of Consultative Democracy Construction—A Perspective of Legislative Consultation

立法协商是协商民主引入立法程序的具体表现,为保障民主立法和科学立法提供了新思路,在中国发挥了一定的社会效果。中国特色立法协商源于建国初期的实践,考察其发展演进过程,先天性不足造成的困境制约了其在法治视域下的作用。对其本土化路径的探析,可从立法原则、立法成本、立法形式以及传统文化中寻求解决思路,以有利于弘扬社会主义协商民主,推进法治和立法的交相辉映。

Legislative consultation is a concrete manifestation of introducing legislative process to consultative democra- cy, which provides a new way to guarantee democratic legislation and scientific legislation, with a certain social effects in China. Legislative consultation with Chinese characteristics originated from the practice of the initial period of China. It can be seen that the plight of congenital deficiency restricted its role under the situation of rule of law from the development progress. Analysis on localization path by seeking solutions from legislation principle, legislation cost, legislation form and traditional culture, is in favor of carrying forward socialist consultative democracy and promoting each other between the rule of law and legislation.
