摘要
用工单位违法退回行为侵害了被派遣劳动者的就业安定权。按照现行规定,派遣单位要对用工单位违法行为造成的损害承担连带责任,以及向劳动者支付被退回未再次派遣期间的工资待遇。派遣单位为了止损,往往会以各种方式解雇或迫使劳动者主动离职,这将使劳动者陷入更加被动的境地。事实上,同为违法退回行为的受害方,派遣单位与被退回劳动者应当是利益共同体而非对抗关系。因此,有必要检讨现行规定所导致的派遣单位与劳动者的囚徒困境,在派遣单位承担责任时区分合法退回和违法退回,补充现有的救济途径,赋予劳动者恢复用工关系请求权,完善程序法和实体法的相关规定,以应对权利行使的障碍。
Illegal return behavior damages the fight of employment security of the dispatched workers. According to the existing regulations, dispatch unit bears joint liability for the damage caused by the labor unit and the payment to the employee during the period they are returned and not sent again. In order to stop loss, the dispatch units often fire workers in a variety of ways, which will make the workers in a more passive situation. In fact, the same as injured party of the illegal returned behavior, the dispatch units and the illegal returned workers are an interests community but not oppositional. In order to protect the workers' legitimate rights and interests well, it is necessary to review the Prisoner's dilemma between the dispatch unit and the labor caused by the existing provisions, improve the existing relief channels, distinguish legitimate returned and illegal returned behavior, give workers the request fight of resuming labor relations , and to perfect the relevant provisions of procedural law and substantial law.
