青年大学生群体法治认同实践的困境破解--从认同的双向规约性生发机理展开 被引量:2

摘要 法治中国化的推进如果缺失社会成员对法治的社会心理基础即法治认同将会举步维艰。法治认同是认同实践在法治维度上的拓延,其对法治化进程发挥内在驱动力的作用。法治认同铺垫法治社会构建所需的社会心理基础,有利于实现对法治认知的纠偏和对实态化法治的审视与修正,并促成法治推进过程中对利益冲突的调整与化解。法治认同的生发机理在于认同主客体间二维向度上的互动规约,从而达致主体的法治化与法治的主体化,在认同过程中还需关注利益感受和情感归依这两个参量的影响。大学生群体的法治认同实践应从其所处的特定成长阶段出发,以利益与情感为导向,注重法治话语体系的构建,补缺法治认同的实践短板,强化家庭的功能释放,科学地创设出认同实践的软环境。 If it is lack of social members' psychological foundation called identification of the law,the advance of the sinicization of the rule of law will be struggling. Identity is the identity of law practice in the future extension of the rule of law dimensions and its inner driving force to the rule- of- law process plays a role. Rule of identity foreshadows the society under the rule of law to build the social psychological foundation,is conducive to the rectification of the cognition of the rule of law and the real state of the rule of law review and correction,contributes to the rule of law in the process of adjustment and resolves conflicts of interest. The rule of law identification germinal mechanism is two- dimensional direction on the interaction between subject and object code to achieve the body the subjectification of rule by law and rule of law still needs to pay attention to the influence of the two parameters for interests of refuge for feeling and emotion in the process of identity. Students groups of identity under the rule of law practice should be defined by the particular stage of growth,interest and the emotion oriented,pay attention to the construction of discourse system,under the rule of law by the practice of the rule of recognition,strengthen the function of family released,and scientifically create the soft environment of identity practice.
