Implementing Comprehensively the Rule of Law and Network Crime Governance

全面推进依法治国,通过法治思维和法治方式推进社会治理,是党中央在全面深化改革的过程中又一重大战略部署。随着互联网的发展,网络与社会生活关系日益紧密,这就要求我们关注网络犯罪的演变,对于出现的新情况与新问题作出应对,促进网络的健康发展。网络犯罪是区别于传统犯罪的新型犯罪类型,其犯罪手段具有区别于传统犯罪的特殊性,社会危害也引起了社会的广泛关注。但是,网络犯罪的快速变化与理论研究形成反差,我国网络犯罪的相关立法较为薄弱,实践中也暴露出种种缺陷和不足,这些弊端严重影响了对网络犯罪的预防和打击。在全面推进依法治国,建设社会主义法治国家的背景之下,有必要进行治理方式和手段的再拓展,进一步完善网络犯罪立法,以有效化解治理难题,维护社会稳定。

Implementing comprehensively the rule of law is the major strategic plan in the comprehensive deep- ening reform. With the development of interact, the relationship between the network and the social life be- comes close, which requires to pay attention to evolution of the network, deal with new situation and promote the healthy development of the network. The rapid of network crime needs theoretical research to change. Un- der the background of building a socialist country according the rule of law, it is necessary to search new ways and means to improve the legislation of network crime. It will help the society solve the problem of governance and social stability.
