摘要
在菲律宾就南中国海问题提出国际仲裁的背景下,美国国务院在2014年12月5日公布的《海洋疆界》第143期中,对南中国海中中国提出的"断续线"做出了三种解释,并就每一种解释与国际法是否吻合做出评论。本文针对第三种解释中所涉及的历史性权利部分进行分析与评论,批驳其中的谬误。
This article comments on the Limits in the Seas, No. 143, issued by the United States Department of State on 5th December 2014. The document reflects the official position of the US Governmentj but does not represent recognition of the legality of the foreign claims discussed therein. In this document, the US Government offers three interpretations for the "dot ted line" in the South China Sea. This article seeks to argue that the dotted line may be accepted by other countries as a claim to the sovereignty over the islands and other features in the South China Sea, and that the Limits confuses the dotted lines as parts of an international border and those of a maritime delimitation line. The conclusion is that the dotted lines may well embrace historic rights other than sovereign, since practice confirms that such rights exist.
