慎微:压力型刑事司法“情法两尽”的思考

刑事司法需要司法者在案件事实和法律规定之间不停往返。压力下刑事司法者保持慎微,以社会共情为补充对刑事个案在法律规定的基础上甄别后区别对待,法尽情依,情尽法随;情以济法,法以济情。刑事司法按照刑事法律以及宽严相济刑事政策的要求做到情法两尽,情法交融,兼顾社会普遍道德期待与公众人伦要求的期许,回应公众基于道德和人伦等提出的合情合理的要求才能真正罚当其罪。得到公众认同或者理性理解的刑事司法的压力将会递减,司法权威和公信随之倍增。
