摘要
随着欧盟法院就2014年"谷歌诉冈萨雷斯被遗忘权案"最终判决的做出,"被遗忘权"成为欧盟国家社交媒体法上一个广受热议的话题,欧盟针对社交媒体的隐私保护策略是给予互联网用户更多的从社交媒介上永久地全部移除他们个人信息的权利。向来崇尚言论自由的美国法律则倾向于认同即使个人不再需要这些社会媒体上的信息,社交媒体公司仍可以在数字化领域内保留一些基本的信息。两种不同的态度的背后是法律信仰、文化传统、社会习惯的差异所致,这种差异在互联网技术广泛应用于社交媒体的21世纪必然会给欧美社交媒体隐私法的司法适用带来影响。
After the EU Court made a final decision to the case of Google v. gonzales in 2014, "the right to be forgotten" become a widely talked-about topic on the EU national social media. The European Union's approach on social media privacy gives users more rights to remove their informatio entirely from the social media permanently. While US' law favors social media companies keeping profile content within the digital sphere even when one person no longer wants it there. Two distincted attitudes reveals the difference of legal beliefs, cultural traditions, and social habits between the EU and US. In the 21st century when Internet technology is widely used in social media, the diverse will inevitably affect the European and American social media privacy laws of judicial application.
