20世纪末以来东、西方法律与文学共舞的态势研究

A Study of the Law and Literature Movement in China and Western Countries Since 1970's

20世纪70年代以来在西方兴起的法律与文学运动,其根本原因在于法律与文学都是探讨人类的正义问题。近30年来,"法律与文学"的研究内容主要集中在"文学中的法律"研究方面,另外"有关文学的法律"、"作为文学的法律"和"通过文学的法律"也是这个跨学科研究的方向。在这场跨学科运动中,西方的法学家和文学家都作出了各自的贡献。然而这场运动自20世纪末引介到中国后,虽然得到了法学界的某些反应,却没有引起文学界的关注。探讨这场运动的发展态势并揭示它在中国发展的现状无疑对于学界认识这场运动具有重要意义。

The essential reason of the law and literature movement that has been developing since the 1970＇s,lies in that both law and literature deal with human justice. In the past 30 years,law and literature movement mainly focuses on law in literature,but law as literature、law through literature and law of literature are also research orientations of this interdisciplinary movement. Both literary and law scholars have made contributions to this interdisciplinary movement. But when the movement was introduced to China at the end of the 20 th century,it received cold reaction both from the law field and literary field. So a study of the situation of the movement and its deficiency in China is of great significance in the recognition of the movement.
