摘要
《高等学校知识产权管理规范》国家标准(以下简称《规范》)的制定与推行,是中国高校知识产权管理的一大尝试。然而,对于中国高校知识产权管理长期存在的知识产权流失严重和成果转化率低两大问题,《规范》的作用极为有限。究其原因,是因为《规范》忽略了高校知识产权管理的特殊性,在条款的设计上出现了缺漏和错位。只有充分认识到学术评价机制、学术道德体系和高校自身性质所导致的特殊性,《规范》才能得到进一步的完善,发挥其应有的作用。
Intellectual Property Management for High Education Institutions( IPM for short) aims to improve the intellectual property management of Chinese high education institutions. However,IPM cannot effectively solve the typical problems such as serious loss of intellectual property and low transformation rate because of the missing and dislocation in clause designing,which are derived from the particularity of high education institutions’ intellectual property management. The study suggests that we should be fully aware of the special characteristics of academic evaluation mechanism,academic ethics system and high education institution to further improve IPM to give its full play.
