从三沙市的生态环境及其保护、政治和社会经济3个方面对三沙市环境保护立法的客观背景做了分析,论述了加强三沙市环境保护立法的必要性,阐述了三沙市环境保护立法坚持的指导思想、遵循的基本原则和对其存在的问题的具体解决途径。三沙市环境保护立法必须坚持生态环保维权的指导思想,遵照科学的立法原则。在具体的立法过程中,注意内容、规划、技术、制度创新等方面的建设与完善,提高三沙环境保护立法的质量,健全和完善具有三沙特色的环境保护法规体系。

This paper analysis the background of environmental legislation from three aspects： ecological and environmental conservation, politics and social economy as well, and deals with the necessity and importance of strengthening the Sansha environmental legislation, then commences the leading idea, the basic principles, which shoud be ascertained in Sansha environmental legislation and detailed settlement methods to the existing problems. Sansha environmental protection legislation should be constructed on the guiding ideology ＂ecological right protection＂ as well as scientific legislative principles. In the detailed environmental legislation process, the legislative contents, plan and technology, legal systematic innovation should be constructed and perfected so that the quality of Sansa environmental legislation can be improved and the legal rules and regulations characteristic can be constructed and perfected.
