摘要
当前我国正在进行《专利法》第四次修改,专利行政保护的去留问题再一次成为争议的焦点。经研究发现,近几年来,专利行政保护在我国的生长土壤依然肥沃,在实践中取得的绩效更加显著,社会对该保护方式的市场需求非常旺盛,因而建议适度加强专利行政保护,并对《专利法(修订草案送审稿)》第60条第2款的修改提出了完善建议。
Currently, the Patent Law is revising the fourth time in our country. Hence, the future of the patent administrative protection becomes the focus of controversy once again. The study found that the growth soil of the patent administrative protection in our country is fertile, the performance of it even more significant in practice, and the market demand of the protection for society is very strong. Therefore, the article recommends strengthening the protection of patent administrative moderately. Besides, the article also put forward a suggestion to the draft amendment of the article 60-2 of Patent Law（Manuscript）.
