论我国罢工权法律规制

摘要 赋予劳动者罢工权是市场经济国家解决劳资冲突的重要手段,体现了国家对劳动者这一弱势群体的保护,对于经济发展和社会稳定具有直接的积极意义。罢工权在绝大多数市场经济国家已经作为普遍的社会经济权利被法律所承认,但在我国,罢工还只是劳资冲突的一种客观表现,并没有被纳入到法律权利体系之中,这不仅不利于维护劳动者的合法权益,而且也不能有效规制罢工行为,导致越来越严重的劳资冲突陷入无法可依的被动之中。我国之所以缺失罢工权立法,其主要原因在于人们思想观念的偏离、政治发展水平的制约、权利意识的缺乏、工会维权机制的缺位等。通过对我国罢工权法定化的必要性与可能性分析表明,我国立法确认劳动者的罢工权已经迫在眉睫。我们应当结合国外先进经验和我国具体国情,从宪法层面和法律层面构建我国罢工权制度,逐步使我国罢工权立法与国际惯例接轨,这也符合当前我国建设社会主义和谐社会的大背景。 Right to strike is one of important measures to resolve labor-management conflicts in market-economy countries, which has positive effects on both social and economic stability and development. The right to strike in the vast majority of market economy countries has been recognized as a universal social and economic rights by the law.
