论农村集体土地制度的深化改革创新

On the Deepening Reform and Innovation in the Rural Collective Land System

中国农村集体土地法律制度与全面推进农业现代化仍有差距。新中国成立以来,中国农村土地所有权制度一直在探索中发展,逐步建立了农村集体土地所有权法律制度。改革开放以来,中国农村集体土地制度正面临着重大改革与创新。引导农村土地经营权有序流转,发展农业适度规模经营,构建新型农业经营体系,法律应尽快明确集体土地所有权、稳定农户承包权、放活土地经营权的"三权分置"新型农村土地使用权制度。

There is a gap between the current legal system of the rural collective land and the comprehensive promotion of agricultural modernization. Since the founding of the new China,the rural land ownership system has been developed through explorations,and the collective land ownership system has been gradually established. Since the reform and opening- up,the rural collective land system of China is facing great reform and innovations. To promote the orderly transfer of rural land operating rights,develop proper- scale operating of agriculture,and build the new- type agricultural operating system,we should establish the ＂three rights separated＂new- type rural land usage right system as soon as possible by explicitly defining the ownership right of collective lands,stabilize the contracting rights of farmer households,and transferring the operating rights of rural lands.
