论新《行政诉讼法》对《行政复议法》修改的影响

On Influence of New Administrative Procedure Law to Revision of Administrative Reconsideration Law

已实施的新《行政诉讼法》较旧《行政诉讼法》有了较大完善。而鉴于行政复议与行政诉讼的紧密关系,新《行政诉讼法》将对行政复议制度的定性、《行政复议法》的立法宗旨和目的、行政复议程序、行政复议决定的形式、行政复议受理方式等都产生较大影响。为此,《行政复议法》的修改必须结合新《行政诉讼法》的相关规定进行完善,以确保与新《行政诉讼法》相衔接。

The new Administrative Procedure Law implemented has improved more than the old one .As the close relation between the administrative review and the administrative litigation , the new Administrative Procedure Law will have a great impact on the revision of the administrative reconsideration law in nature , legislative purpose , review procedure , decision forms ,accepting ways ,etc .Therefore ,the revision of Administrative Reconsideration Law must be combined with the relevant provisions of the new administrative procedure law to ensure that it is connected with the new Administrative Procedure Law .
