数字著作权交易法律模型论纲

A Legal Model Outline of Digital Copyright Transaction

本文基于互联网背景下著作权制度的法律要素分析,将法律模型论的方法引入数字著作权法律理论研究工作中,提出著作权交易法律模型的概念,并对构建著作权交易法律模型应遵循的基本原则及该模型的基本结构作了初步论述。以期对数字时代我国数字著作权立法的理论有所裨益,进而有助于完善我国著作权立法。

Based on the analysis on legal elements of the copyright system under the background of Internet,we introduce methods of legal model theory to digital copyright＇s legal theory research work,put forward the legal model concept of copyright transaction,and make a preliminary discussion on constructing basic principles that should be followed by the legal model of copyright transaction and the model＇s basic structure,which is to the benefit of our country＇s digital copyright legislation theory in digital era and then is helpful to improve our country＇s copyright legislation.
