我国建设工程监理人的内涵分析与完善研究

Research on the Analysis and Improvement of the Supervisor Connotation of Construction Project in China

对《建设工程监理合同(示范文本)》(GF-2012-0202)和《建设工程施工合同(示范文本)》(GF-2013-0201)中"监理人"的内涵进行分析。分析表明上述合同文版中"监理人"的内涵模糊,使得"监理人"与监理工程师的职责范围重叠甚至矛盾。基于此,对比我国现行监理规范中监理工程师的职责范围并参照FIDIC条件下的"咨询工程师"(Consultant)和"工程师"(Engineer)定义,提出完善2012版《监理合同》和2013版《建设工程施工合同》关于监理人定义的建议。

The paper analyzes the connotation of supervisor in both Construction Project Supervision Contract （model text）（GF-2012-0202）and Construction Contract for Construction Project（model text）（GF-2013-0201）. The analysis show that the connotation of supervisor is vague which makes responsibilities overlap between supervisor and supervision engineer even contradiction.Then,contrasts the responsibilities of the supervision engineer in supervision specification in China and refers to the defination of Consultant and engineer under FIDIC contract conditions,puts fomard suggestions to improve the defination of supervisor.
