中央与民族自治地方的协商机制研究——基于1998年北爱尔兰法的启示

On Consultative Democracy System from the Perspective of 1998 Northern Ireland Act

英国1998年北爱尔兰法案对于北爱尔兰问题的解决影响深远,与我国民族区域自治在立法、行政、司法、财政和税收等方面存在诸多共性。北爱尔兰法案中构建的规范化的全方位多层次的协商机制,为北爱尔兰的发展以及中央权力下放事项起了重要的保障作用。针对我国目前中央与民族自治地方的协商机制所存在的问题,必须要明确和充分尊重民族自治地方的协商主体的地位,并充分发挥国家民委在沟通衔接方面的职能。

The Northern Ireland Act 1998 of UK has exerted great influence over the peaceful resolvement of the troubles in Northern Ireland,which contains some commen sysmatic design at legislative,exceutive,judicial,fisical and tax aspescts, compared with chinese ethnic regional autonomy. The multilateral negotiation mechanism constructed in the act guarantee the development of Northern Ireland and the devolution issues. In view of the problems in current negotiation between central government and ethnic autonomous areas,centra government should identify and pay full respects to ethnic autonomous regions＇ status of negotiation agents, and the negotional and connective function of state ethnic affairs commission should be given full play.
