少数民族地区法制现代化的障碍及其应对策略

少数民族地区的法制现代化是推动少数民族社会由人治型法律体系向法治型法律体系的变革与转型过程,现代少数民族法制追求已跳出了传统地缘政治的框架,转变为少数民族社会机制完善与文化资本整合利用的有力武器,其核心是少数民族政治、经济、文化的现代化。基于对民族地区法制现代化进程的障碍分析,关注民族区域自治与国家公共权利的制衡,主张现代民族法制内容与形式在法律主体的民族享有或专有范围内反映地方需求和民族特色。以我国多民族社会共同创造的文化传统为起点,把握国家多元一体的法文化全貌,为民族地区法律现代化建设提供理论依据和实践方式。

The modernization of the legal system in minority areas is to promote minority society by man type legal system to the rule of law legal system reform and the transformation process,the pursuit of modern legal system of minority nationality has jumped out of the traditional framework of geopolitics, transforming itself into a powerful weapon for the integration and utilization of minority society mechanism and cultural capital,its core is minority political,economic and cultural modernization, this paper analyzes the legal modernization in Minority Areas Based on the balance of attention disorder,ethnic regional autonomy and national public rights,advocating modern national legal content and form in the legal subject or nationalities enjoy exclusive area reflect the demand of local and national characteristics, to create a common Chinese national the traditional social culture as a starting point,grasp the state of pluralistic law culture,to provide for the construction of the modernization of law in Ethnic Regions Theoretical basis and practical methods.
