The Balance between Administrative Power and Civil Rights

各地实施的机动车区域限行政策,本质上都体现了行政权力对公民权利的限制。行政权力与公民权利的效力来源、利益指向和法律地位等均有所不同。实现行政权力与公民权利的平衡,应遵循权利本位、公共利益、合理补偿和程序正义等原则。当前机动车区域限行政策,在合理补偿和程序正义等原则上有所缺失,这有悖于行政权力与公民权利的平衡关系。

Traffic restricting policy essentially reflects the restriction of civil rights exerted by the administrative power. There are differences in sources, interest orientation and legal status between administrative power and civil rights. In order to achieve the balance between administrative power and civil rights, it should follow the principles of right standard, public interests, fair compensation and procedural justice. The current traffic restriction policy has been lacking the principle of fair compensation and procedural justice ,which runs contrary to the balance between the administrative power and civil rights.
