论非物质文化遗产的知识产权保护

On Protection of Intellectual Property Rights of Intangible Cultural Heritage

非物质文化遗产的知识产权保护研究具有明确创作权属,激发创造艺术,弘扬文化传统,促进文明传承的重大意义,近年来,被广泛讨论。本文在对非物质文化遗产的概念进行阐述的基础上,着重论证其与知识产权客体的关系,从我国非物质文化遗产的保护现状等角度入手,具体分析非物质文化遗产知识产权保护的必要性和可行性。在保护趋势上,对非物质文化遗产提出完善知识产权保护体系、确立区域族群的权利主体地位、坚持多元保护原则、遵循有限保护原则的观点。

Research on the protection of intellectual property rights of intangible cultural heritage has great significance in de- fining the belonging of copyright, inspiring the art of creation, promoting culture tradition and improving the inheritance of civi- lization. In recent years, this topic has been discussed widely. This thesis is based on the explanation of the conception of intangible cultural heritage and pays more attention to the relationslaip with inteUectual property object. From the angle of current situation, thisthesisanalyzesthene^essityandfeasibi^ity^ftheinteue^tualpr^pertypr^tecti^n~fintangib^e~u^turalheritage. As for the protection tendency, the author proposes the following opinions： improving intellectual property protection system; es- tablishing the dominant position of regional ethnic group; insisting on the rule of multiple protections and complying with limited protection principle.
