规制非婚同居行为的法理思考

A Legal Reflection on the Regulation of Unmarried Cohabitation

非婚同居现象渊源深远,无论中国还是西方社会,非婚同居的数量增加是新世纪的共同现象。不同的是,西方社会大多将非婚同居纳入法律调整的范围,而我国的法律基本上还是采取漠视和回避的态度。基于中国社会的现实以及国际社会的发展趋势,对规制非婚同居行为进行法理思考,并提出了规制非婚同居行为的法律构想,应对完善我国的婚姻立法有所裨益。

Unmarried cohabitation has a profound origin. In the new century, there was an increase in the number of unmarried cohabitants both in China and in western countries. The difference lies in the fact that most of western countries regulate the unmarried cohabitation but China basically takes the attitude of indifference and avoidance. Based on China ＇s social reality and the international development trend, the legal conception resulted from reflection, on how to regulate unmarried cohabitation will benefit our country＇s marriage legislation.
