政府市场价格监管权边界的法经济学重构

The Reconstruction of the Boundary of The power of Price Supervision and Inspection: From the Perspective of Legal- economics

《价格法》规定的价格监督检查权存在着边界不清,权力行使方式过于简单的问题。这从根本上源于价格干预理论的缺失,主流宏观经济学中的价格粘性理论为基础,结合我国商品市场的实际情况,可重构我国价格监督检查权。采用新的符合市场经济规律的实质审查标准和柔性执法模式从根本上解决市场价格干预的效率问题。

The power of price supervision and inspection stipulated by Price Law exists problems of having obscure boundary and the oversimple method of power exercising. The reasons for these problems are lacking of price intervention theory. Based on the Sticky- Price theory and the reality of Chinese commercial market,we could reconstruct the power of price supervision and inspection. We could adopt the substantive examination standard which is conformed to the market rules and soft model of law enforcement to fundamentally settle the issue of efficiency in market price intervention.
