摘要
公正是社会制度的首要价值,对正义的追求乃是中国传统文化的核心价值取向。中国传统正义思想的理论构建始于三代以来形成的以"执中"为核心的政治传统,其理论雏形便是《尚书》中提出的"王道"正义论思想。在此基础上,孔子及历代儒家正义思想的理论构建主要以为制度作合法性辩护和建立贤能政治模式为旨归,提出了基于仁爱原则的分配正义论,以"时中"为取向的实践正义论,以及以"行权"为补充的矫治正义论等三个理论层面,构建起了一种以"中重于正"思想为特点的"时中"正义论,它对当代正义论构建具有重要的理论价值。
Justice is the first virtue of social institution,the pursuit of justice is the core value orientation of Chinese traditional culture. The theory of traditional Chinese justice thoughts building begins with three generations since the formation of the "Stick to justice"as the core of political tradition. In addition,the theoretical prototype is put forward in the history of "benevolent government"justice theory. Based on these,theory of Confucius and the Confucian thought of justice and legitimacy mainly consist of thought system and establish good political model for the purpose. They put forward the theory of distributive justice which based on the principle of charity,with "the time- dependent mean"for the orientation of the practice of the theory of justice and expediency as supplement of the correct justice theory. The characteristic of theory is"Moderation Is More Important than Justice". It is important for the contemporary justice theory to construct the theory of value.
