学者库建设与服务中的著作权侵权控制研究

Research on the Control of Copyright Infringement in the Construction and Service of Scholar Repository

图书馆在建设学者库的过程中,对已经发表并转让著作权的作品、已经发表的未转让著作权的作品、放弃著作权中财产权的OA作品以及未公开发表作品的获取,依据其各自不同的著作权状况,应采取不同的措施来控制侵权的发生;图书馆在利用学者库提供服务时,应争取到著作权法律制度的支持、选取适当的著作权授权使用政策、制订可行的控制措施,以保障图书馆和学者个人的著作权利益不受侵害。

In the construction of scholar repository, different measures should be taken according to various of copyright conditions of works, such as works have been published and transfered the copyright, works have been published but not transfered the copyright, OA works have been given up property right of copyright and the access of works published unpublicly. In the service of scholar repository, the library should seek to support of copyright law system, select appropriate policy of copyright authorization, and formu- lating feasible control measures, so as to protect the library and scholars from being infringed the copyright interest.
