基于法解释论的立法文本英译等效探究

Exploration of Equivalence on English Translation of Chinese Legislative Text

面对我国立法文本英译工作缺乏具有明确法律意义的系统理论指导和实践操作标准的具体现实,本文从奈达等效理论出发,以法律解释为工具,将等效理论运用到立法文本翻译研究中,构建法律等效概念。通过法律解释的具体运用,本文将等效理论的三项内涵(主要精神、具体事实和意境气氛)在立法文本翻译中具体化为立法意图、法律事实、法律语言特征和法律适用效果四项法律等效参数,并对我国立法文本英译译本进行了实证剖析,以期为我国立法文本英译工作提供理论和实践支持。

Aiming to provide clear systematic theoretical guidance and pragmatic norms with legal perspectives for English translation operation of Chinese legislative texts,the paper exploratorily applies the equivalence theory of Eugene A. Nida into English translation process of Chinese legislative texts and builds up the concept of legal equivalence through application of legal interpretation,which further helps the author specify the three contents of equivalence theory into four parameters forming legal equivalence in legislative text translation. In the end,these findings are illustrated and evaluated in existing English translations of Chinese legislative texts so as to arouse certain theoretical and practical inspiration for English translation work of Chinese legislative texts.
