摘要
近年来,信访作为一种"本土化"的权利救济方式呈现出新的特点,涉法涉诉信访案件的处理能力和水平直接影响到社区的和谐乃至社会的安定,而如何有效地终结涉检信访案件也成为近年来理论界和检察机关密切关注的重要课题。文章从涉检信访案件的类型及其特点分析出发,论证了终结机制所要发挥的基本法律功能、所要执行的基本终结标准,并针对"诉访分离"等现实焦点问题进一步提出了构建涉检信访案件终结机制的体系化构想。
As a localized right remedy,petition has recently demonstrated new features. The handling ability and level on law- related and lawsuit- related cases directly decides community harmony and social stability. How to effectively terminate inspection- related petition cases has become an important issue that theoretical and procuratorial organ pays close attention. The article started from the types and features of inspection- related petition cases,discussed the basic legal function that termination mechanism would play and basic termination standard that termination mechanism would execute and put forward systematic imagination on building termination mechanism on inspection- related petition cases to the present focal issue of separation of lawsuit and petition.
