依宪治国背景下人民民主专政形态的创新性建构

Creative Construction of People's Democratic Dictatorship against the Background of Governing the Country by Constitution

人民民主专政的本质是人民当家作主。我国现行的宪法从阶级属性、人民民主属性、社会主义属性等维度对人民民主专政本质及其特点作了深刻揭示。依宪治国必须坚持人民主体地位。基于人民主体地位的变迁,人民民主专政的表现形态如阶级专政、民主专政、依法专政等,既有其产生的历史必然性和现实正当性,也因而有其时代局限性。在当前依宪治国的背景下,宪法专政理应成为当下人民民主专政的创新性形态。作为维护宪法秩序、维护人民主体地位的根本手段,宪法专政的直接目的在于结束危机、恢复依宪治国的治理常态。为此,要确保宪法专政有效运行,宪法的权威性和人民的主体性绝不应当被悬置,必须落实到治国理政的方方面面。

The essence of people＇s democratic dictatorship is that people coming from different walks of life and abiding by the law form the ruling class of their country. The current constitution of China specifies the essence of people＇s democratic dictatorship from the perspectives of the class formation,people＇s democracy,and socialist system. Corresponding to the changes in people＇s subject-hood,people＇s democratic dictatorship has shown different forms like class dictatorship,democratic dictatorship and law-based dictatorship. All these forms have been produced by the requirements of the times but each has their own historical limitations. In the current situation where the country should be governed by the constitution,the constitutional dictatorship should be the new form of people＇s democratic dictatorship. As a basic means for safeguarding the constitutional order and people＇s subject-hood,the ultimate purpose of the constitutional dictatorship is to end crises and restore the governance normal of ruling the country by the constitution. Therefore,we have to see to it that the constitutional dictatorship should be effectively implemented and that instead of being suspended,the constitutional authority and people＇s subjectivity should be embodied in every aspect of our governance.
