Yang San'e's Litigation: The Morality, Law and Public Opinion in the Lawsuit Intiated by a Woman in the Early Repubic

杨三姐告状案是民国初年轰动一时的女性诉讼案。案件源于华北乡村社会在性别权力关系上的失衡。女性对诉讼领域介入,既是对男性权力的挑战,也暗示着导向社会结构改变的因素开始出现。由女性所发起的诉讼案进入审判流程后,道义、法律与舆情的互动关系也呈现出了较为复杂的态势。这在一定程度上对女性群体维权意识的培养起到了促进作用。

Yang San Jie（Yang＇s 3rd Sister） pursued litigation in Hebei province in 1918 and created a sensation as a lawsuit initiated by a woman. This lawsuit found roots in the gender-based imbalance in power relationships in rural society in northern Hebei. A woman who decided to use the legal system to challenge patriarchal authority was a sign of women＇s determination to lead social change. However, during the process of the lawsuit, the legal, moral, and public opinions intersected and formed a complex atmosphere, which helped the case as well as the woman litigant and the raising of awareness of women＇s rights as a group.
