摘要
目前我国社区矫正基层工作人员的身份是乡镇街道司法所的司法助理员,这种配置在理论上和实践中存在诸多争议和问题。从社区矫正工作的专业化、必要的分工、贯彻按劳分配原则以及司法所工作性质的差异和社区矫正工作的长远发展来看,司法助理员不适合承担社区矫正工作。我们需要建立相对独立、专业的社区矫正队伍。通过确立社区矫正工作人员的准入标准,建立岗位级别和专业职称以及与工作性质相匹配的考核制度,适当考虑工作人员的分工和强度,完善非执法人员的招募和聘用制度,同时确保社区矫正执法者具有必要的强制执行权。
Currently,the identity of primary-level workers of community-based correction in China is the juridical attendants from the judiciary of township,and it proved from practice that there exist many problems in community corrections undertaken by juridical attendants. The juridical attendants are not fit for community corrections from the aspects of specialization of community corrections,necessary labor division,and implementation of principle of distribution according to works,difference of job nature of the judiciary and long-term development of community corrections. Thus an independent,professional community correction team needs to be established. Community corrections should be made to be a promising occupation by confirming the admittance criterion of manager of community corrections,building positional ranks,professional title and appraisal system matched with its job nature,considering properly the staff's labor division and strength,improving the system of recruitment for non law-enforcement personnel,and guarantying that the enforcer of community correction is equipped with the needful enforcement authority.
