摘要
本文主要从两岸“政府采购制度”的立法目的及监督制度做介绍,对比了采购的招标、投标、开标制度的异同,对两岸“政府采购法”以及大陆《招标投标法》进行比较分析及探讨,以期大陆正式加入GPA修订《政府采购法》及《招标投标法》时以启发借鉴。文中首先介绍两岸采购制度的沿革、制定、立法目的、主管机关及监管,其次就采购招标制度之比较及两岸的投标与开标做一比较,更进一步探讨评标和决标的两岸比较,最后则以结论与建议做归结,并提出本文之管见,予两岸主管当局、立法机关及法学先进、采购单位及公共采购投标厂商参考。希望本文也能对大陆即将加入GPA之政府采购制度及招标投标制度之修法而提供台湾地区经验(以下简称台湾),尚祈相关先进及学者专家指致是幸。
This article introduces both legislative goals and supervision systems of Government Procurement Acts in Taiwan and China's Mainland, and compares the similarities and differences on tenders, bids, and tender opening and award aspects, for suggestions on amending these Acts. First of all, this article introduces legislative history, legislative goals, government authorities and supervision approaches. Second, Compares tenders and the tender opening system on Government Procurement Act for both sides in order to explore tender evaluation and tender award. Finally, the author provides acts amending suggestions as conclusion. Hopefully, this article can provide Taiwan Residents experience for China' s enacting Government Procurement Act in the future.
