乡土社会变迁中礼治与法治的冲突与整合

On the Contradiction and Integration between Rule of Rites and Rule of Law in the Changes of Local Society

费孝通笔下的乡土社会是一个"无讼"的社会,礼治是其维护秩序的手段。然而随着乡土社会的变迁,农村的产业结构和人们的思想观念发生了变化,礼治秩序呈现弱化的趋势。与此同时,国家正式的法律制度大规模地进入乡土社会但遭遇重重困难。因此,分析礼治与法治的具体冲突,探索二者整合的路径,对于完善法律制度和维持乡土社会的稳定有着重要的现实意义。

The local society depicted by Fei Xiaotong is a society without criminal cases,and rule of rites is the means to maintain its order.However,with the changes of local society,changes have taken place in rural industrial structure and people＇s ideological concept,gradually weakening rule of rites.Meanwhile,national laws and regulates are popularized in local society on a large scale,but encountered many difficulties.Therefore,we should analyze the specific contradiction between rule of rites and rule of law and explore ways to integrate them,in order to improve the legal system and maintain the stability of local society.
