摘要
通过案例分析,识别出PPP模式存在增加权利寻租空间,合同周期长、不确定性大且不完备,以及依赖咨询机构的专业性等特征和隐患。因法律与合同的约束具有滞后性,制定并执行对政府部门、咨询机构以及投资企业从业人员的职业伦理规范,可作为改善以上问题更为灵活的补充监管机制。然后通过对比分析国际上四大代表性建设管理职业机构的职业伦理规范,阐述PPP相关从业者的职业伦理核心要求。最后,提出对PPP职业伦理制度建设的建议。
Through case studies,this paper identifies the features and hidden dangers of Public Private Par tnerships(PPP)model regarding to increasing power rent-seeking,long-ter m,high-uncer tainty and incomplete contract,and heavy reliance on professionalism of consultancies. Since legal and contractual binding force have a lag in dealing with these problems,establishing and implementing a code of PPP professional ethics for PPP participants including public officers,consultants and lawyers,and investors can act as a more flexible and supplemental regulatory mechanism. This paper further reviews and compares ethics codes set by four representative international professional bodies relevant to construction management,and elaborates the essential elements of professional ethics for participants. In the end,proposes recommendations on the institutional construction of PPP professional ethics.
