P2P平台非自然人投资者的金融消费者身份之辩

摘要 金融消费者的内涵范围在学术界和实业界争议较大,因为其背后牵涉未来金融消费者保护统合立法的基础问题,即该保护谁?金融消费者保护的理论核心在于存在信息不对称下的弱势地位,不同于传统消费者概念,金融消费者与提供金融服务的机构之间差异悬殊。所以,金融消费者也应该突破过去传统消费者概念对主体的限制。在P2P投资平台信息不对称的情况下,非自然人主体也未必具有传统机构投资者的"强势地位",P2P平台的非自然人投资者面临着机构不健全、资金不充足、维权能力弱的问题。因此,P2P平台的非自然人投资者也应纳入金融消费者的范围予以保护。 The connotation of financial consumer' s scope in academia and industry are controversial, because behind the problems involving the basis of future financial integration of consumer protection legislation:who should be protected? Financial consumer protection theory' s core lies in the weak position of consumer, under the asymmetric information different from the traditional concept of consumer, financial differences between consumers and provide financial services. So, the financial consumers should also break through the past traditional concept on the limitation of subject. Investment in P2P platform under the condition of asymmetric information, the natural person may not have the traditional institutional investors "strong position", P2P platform of natural person investors facing the mechanism is not sound, money is not enough, weak ability of safeguarding rights issue. Therefore, P2P platform' s natural person investors should also be included in the scope of financial consumer protection.
