征地过程中程序性权利保障与农民满意度研究——基于辽宁省6市30村的调研

Study on the Procedural Rights Guarantee and Farmers' Satisfaction in the Process of Land Acquisition:Based on the Investigation of 30 Villages,6 Cities in Liaoning Province

研究目的:检验征地过程中程序性权利的保障对被征地农民满意度的影响,为改革征地制度提供相关的政策建议。研究方法:随机抽样调查法和有序多分类Logit模型。研究结果:征地过程中农民的知情权与满意度成负相关关系,参与权能显著提高满意度;表达权和监督权由于实际中不能有效落实,其影响不显著,但二者的改善有助于提升农民的满意度。征地补偿标准和被征地者是否为村干部显著影响征地的满意度且影响方向为正。研究结论:征地制度改革中既要加强对农民的补偿安置等实体性权利保障,同时也应该充分重视农民程序性权利的保障。应加强和完善"两公告一登记"制度,给予农民平等的谈判权利,畅通利益诉求渠道,加强行政和司法监督。

The purpose of this paper is to inspect the influence of procedural rights guarantee on farmers＇ satisfaction so as to provide related policy recommendations for land acquisition institution reform.Methods employed include Random Sampling and Ordered Multicategorical Logit Model.The results indicate that there is a negative correlation between farmers＇ right to know and their satisfaction,and farmers＇ right to participate can significantly improve their satisfaction; due to the ineffective implementation of rights to express and supervise in practice,their influence are not remarkable,however,both of them can promote the satisfaction of famers if they get improvement.Compensation standards of land acquisition and the position of the farmers（i.e.grassroots cadre or not）have significant influences on farmers＇ satisfaction and the impact is positive.It is concluded that in the process of land acquisition institution reform,we should strengthen the substantive rights,such as farmers＇ rights for compensation and resettlement,etc.,as well as should pay full attention to procedural rights guarantee.This paper suggests that we should enhance and improve the system of ＂Two Announcements,One Registration＂,should provide farmers with equal bargaining right,should improve the channel of farmers＇ benefit claim and strengthen administrative and judicial supervision.
