论扰乱无线电通讯管理秩序罪的立法修改

On the Deficiencies and Legislative Improvement of Radio Management of Criminal Law Norms

无线电是重要的国家资源之一,我国无线电已广泛应用于我国社会生产、生活各领域。对无线电的刑法保护有助于保障国家安全、社会稳定以及人民的生命财产安全。我国1997年《刑法》第288条扰乱无线电通讯管理秩序罪设置行政前置程序很不科学,"结果犯"的设置具有明显的局限性,该罪的法定刑配置较低且缺乏层次,罪状表述不完善,相关罪名之间不协调。基于无线电保护的现实需要,《刑法修正案(九)》删除了扰乱无线电通讯管理秩序罪的行政前置程序,将"造成严重后果"的定罪条件改为"情节严重",增设相应的加重罪刑单位和量刑档次,改进现行法条中的部分用词并整合相关立法,以实现对无线电更为有效的刑法保护。

Radio is one of the important national resources, our radio has been widely used in various fields of social production and life. Criminal Protection of radio helps to protect national security, social stability and people＇ s lives and property. China＇ s 1997 Penal Code Section 288, the crime of disrupt radio communications management order sets administrative pre - crime procedures which is unscientific, ＂ the results guilty＂ setting has obvious limitations, legal punishment of the crime is low and lack of level, presentation counts imperfect ,lack of coordination between relative crimes. Based on the practical needs of radio protection, it is necessary to delete administrative pre - order procedures, correct the ＂serious consequences＂ of conviction condition to ＂serious cases＂, add the appropriate units and aggravated crime and sentencing grades, and improve the existing words and integrate relevant legislation, in order to achieve an effective criminal law protection to radio.
